1. About BubbaSeat

BubbaSeat ("we", "us", "our", "the Platform") is a technology platform that connects families ("Customers") with independent drivers ("Drivers") who provide child car seat transportation services. BubbaSeat is operated in New South Wales, Australia.

BubbaSeat is a technology platform only. We are not a transportation company, taxi service, or ride-share operator. We do not employ drivers, own vehicles, or directly provide transportation services. We facilitate connections between Customers and independent Drivers.

2. Acceptance of Terms

By accessing or using the BubbaSeat website, booking a ride, or registering as a Driver, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our Platform. We reserve the right to modify these terms at any time with 30 days' notice. Continued use of the Platform after modifications constitutes acceptance of the updated terms.

3. Driver — Independent Contractor Status

Drivers who register on the BubbaSeat Platform are independent contractors and are not employees, agents, or representatives of BubbaSeat. Drivers:

  • Operate their own vehicles and supply their own child car seats
  • Set their own availability and may accept or decline any ride request
  • Are responsible for their own tax obligations, including GST and income tax reporting through their ABN
  • Are not entitled to employee benefits including but not limited to wages, superannuation, workers' compensation, leave entitlements, or insurance coverage from BubbaSeat
  • Must maintain their own insurance and licences at all times

4. Driver Requirements and Obligations

To register and remain active on the Platform, Drivers must maintain at all times:

  • A valid, unrestricted Australian driver's licence (full licence, not provisional or learner)
  • A valid Working With Children Check (WWCC) as required by the relevant state or territory
  • Comprehensive motor vehicle insurance that covers ride-share or commercial use
  • Current vehicle registration
  • Child car seats that comply with Australian Standard AS/NZS 1754
  • A clean criminal history (no serious driving offences, no offences against children)

BubbaSeat reserves the right to verify, audit, and request updated copies of all documents at any time. Failure to maintain current documentation will result in immediate suspension or termination of the Driver's account.

5. Driver Responsibilities and Duty of Care

The Driver assumes full and sole responsibility for the safety of all passengers during any ride facilitated through the Platform. This includes but is not limited to:

  • Child Restraint Safety: Correct installation, fitting, and use of child car seats in accordance with Australian Standard AS/NZS 1754 and all applicable road rules. The Driver must ensure the appropriate seat type is used for each child's age, weight, and height.
  • Road Safety: Compliance with all NSW Road Rules and applicable traffic laws, including speed limits, road conditions, and safe driving practices at all times.
  • Vehicle Condition: Ensuring the vehicle is roadworthy, clean, well-maintained, and safe for transporting passengers, including children.
  • Sobriety: The Driver must not operate the vehicle under the influence of alcohol, drugs, or any substance that impairs driving ability.
  • Insurance Coverage: Maintaining valid and adequate insurance coverage for every ride undertaken through the Platform.
  • Professional Conduct: Treating all passengers with respect, courtesy, and professionalism.

6. Limitation of Liability

To the maximum extent permitted by law:

  • BubbaSeat is not liable for any injury, death, property damage, loss, or any other claim arising from or related to any ride facilitated through the Platform.
  • BubbaSeat is not liable for the actions, omissions, negligence, or misconduct of any Driver.
  • BubbaSeat is not liable for the correct installation or use of child car seats.
  • BubbaSeat makes no guarantees regarding service quality, timeliness, availability, or the suitability of any Driver.
  • BubbaSeat's maximum aggregate liability for any claim arising from or related to the Platform shall not exceed the total amount paid by the Customer for the specific ride giving rise to the claim.

7. Indemnification

Drivers agree to indemnify, defend, and hold harmless BubbaSeat, its owners, directors, officers, employees, and agents from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or in connection with:

  • The Driver's provision of transportation services
  • Any accident, injury, or property damage occurring during a ride
  • Incorrect installation, fitting, or use of child car seats
  • Any traffic infringement, fine, or penalty incurred by the Driver
  • Any breach of these Terms of Service by the Driver
  • Any claim by a Customer, passenger, or third party arising from the Driver's conduct
  • The Driver's failure to maintain required licences, insurance, or documentation

8. Insurance

Drivers are solely responsible for maintaining comprehensive motor vehicle insurance that covers commercial or ride-share use. Drivers must:

  • Notify their insurance provider that the vehicle is used for ride-share or commercial passenger transport
  • Ensure their insurance policy provides adequate coverage for all passengers, including children
  • Use their own insurance in the event of any accident or incident

BubbaSeat does not provide any insurance coverage for Drivers, their vehicles, passengers, or any third parties. BubbaSeat is not responsible for any gap in the Driver's insurance coverage.

9. Customer Terms

By booking a ride through BubbaSeat, Customers acknowledge and agree that:

  • BubbaSeat is a technology platform that connects Customers with independent Drivers
  • BubbaSeat does not directly provide transportation services
  • The Driver is solely responsible for the safety of passengers during the ride
  • Customers should verify the Driver's identity, vehicle, and child seat setup before commencing any ride
  • Customers must provide accurate information about each child's age and needs when booking
  • Cancellation and refund policies apply as outlined in Section 10

10. Payments, Cancellations and Refunds

All payments are processed securely through Stripe. Ride fares are calculated based on distance, tolls, and applicable fees. Prices are shown in Australian Dollars (AUD) and include GST where applicable.

If no Driver accepts a ride request within 30 minutes of payment, the booking will be automatically cancelled and a full refund will be issued. Refunds are processed via the original payment method and may take 5–10 business days to appear.

Estimated toll charges are included in the fare. If tolls are not incurred during the ride, the toll portion is refundable upon request.

11. Account Termination

BubbaSeat reserves the right to suspend or terminate any Driver or Customer account at any time, with or without cause, and without prior notice. Reasons for termination may include but are not limited to:

  • Customer complaints regarding safety or conduct
  • Failure to maintain required documentation
  • Breach of these Terms of Service
  • Fraudulent activity
  • Any conduct that BubbaSeat deems harmful to the Platform or its users

Upon termination, no compensation or severance is owed to the Driver. Drivers may also voluntarily deactivate their account at any time.

12. Confidentiality

Drivers agree to keep all Customer information strictly confidential. Customer personal information (including names, addresses, phone numbers, and travel patterns) may only be used for the purpose of completing the assigned ride. Drivers must not:

  • Contact Customers outside of the Platform for any reason
  • Share Customer information with any third party
  • Store or retain Customer information after the ride is completed

13. Intellectual Property

All content on the BubbaSeat Platform, including but not limited to logos, trademarks, text, graphics, and software, is the property of BubbaSeat and is protected by Australian intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written permission.

14. Dispute Resolution

Any disputes arising from or related to these Terms shall first be attempted to be resolved through good faith negotiation and mediation. If mediation is unsuccessful, the dispute shall be resolved in accordance with the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of the courts of New South Wales.

15. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of New South Wales, Australia. Any legal proceedings must be brought in the courts of New South Wales.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
